What is Employment Discrimination?

When hiring workforce it is illegal to discriminate people on the base of race, religion, gender or national origin illegal.

  • Paying different wages to equally-qualified workers for the same work.

  • Discriminating by assigning jobs to people that are in maternity leave and disability leave, or retirement options.

  • Forbidding for certain employees the use of company facilities

  • When promotions or lay-off is done discriminating some of the workforces.

Discrimination Legislation and Issues

Age Discrimination

Age discrimination is against the law, it is forbidden by the law.

It is forbidden to advertise an age preference in jobs ads.

It is the law, you can not pay difference salaries because of the difference in age. 23 years old and 45 years old doing the same job will have to be paid the same salary. Age discrimination in internship opportunities or apprenticeship programs is illegal too.

Religious Discrimination

Religion can not be a reason for any kind of employees discrimination as it is forbidden by law. Employers should facilitate and respect the employee’s completion of his or her beliefs. For example, a Muslim employee will need to pray during work. The employers have the right to stop any excessive negative results to their businesses.

Gender Discrimination

It is forbidden by law to pay different compensation to different genders, mostly it will be paying fewer wages to women than to the men for the same responsibility, qualifications, Skills, and position. The law does not permit to discriminate employees on the base ODF gender. It is not allowed to lower the salary of one gender to equalize the wages between men and women.

Pregnancy-Based Discrimination

It is illegal to discriminate pregnant employees. Pregnancy is considered as any temporary illness that may need special conditions.
Employment seekers that are pregnant, have the protection of the Pregnancy Discrimination Act (PDA) passed in 1978.

Hostile Work Environment

When harassment or discrimination interferes with the work performance of the employee and creates an offensive and harsh environment for an employee or a group of employees.

Illegal Discrimination and Harassment

Discriminatory action can happen in a different aspect of employment. An employer will be acting unlawfully if he or she takes action based on race, gender, or age-related of the employees or candidates for a job, the same unlawfulness will be in the cases of assuming that a person will be incapable if he or she is disabled.

Employers  can not withhold legally employment opportunities from people that have a relationship with different race, religion or ethnicity

 

Complaints about Employment Discrimination

The United States labor law does not permit employers to unfairly treat employees or flagrantly discriminate workers based on the protected by the law characteristics. Once a complaint and investigation were made by an employee it is illegal to retaliate against this employee.

It is important to say that not all unfavorable treatments are unlawful actions. The employee that think that he or she were treated unfairly at the workplace can file a complaint using EEOC (The Equal Employment Opportunity Commission).
